1. Acceptance of Terms

By using Kleonote, you acknowledge that you have read, understood, and agree to these Terms, as well as our Privacy Policy, which explains how we collect and process your data. If you are using Kleonote on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

We may update these Terms from time to time. Any changes will be reflected within the app or on our official page. Your continued use of Kleonote after changes means you accept the updated Terms.

2. Eligibility

To use Kleonote, you must be at least 16 years old or have consent from a parent or legal guardian. By using the app, you confirm that you meet these requirements and that the information you provide is accurate and complete.

3. Use of the App

Kleonote allows users to record, transcribe, summarize, and manage voice notes using artificial intelligence. You agree to use the app only for lawful purposes and in compliance with all applicable laws and regulations.

You agree not to:

• Copy, reproduce, modify, or distribute any part of the app without prior written consent
• Reverse-engineer, decompile, or attempt to hack any part of the app or its systems
• Upload or transmit malicious code, viruses, or harmful material
• Record other individuals without their consent
• Use the app in a way that infringes the rights of others

4. Account and Security

Some features may require account creation. You agree to provide accurate and up-to-date information and to keep your login credentials secure. You are responsible for all activity under your account.

If you believe your account has been accessed without authorization, you must notify us immediately at [email protected].

5. Subscriptions and Payments

Kleonote offers free and paid subscription plans that unlock additional features. Payments are processed securely through Apple's App Store using your Apple ID.

Subscriptions automatically renew unless canceled at least 24 hours before the renewal date. You can manage or cancel your subscription at any time through your App Store account settings. Prices may vary by region and currency. We reserve the right to change pricing with prior notice.

We do not store or have access to your payment information.

6. Free Trials and Promotions

From time to time, Kleonote may offer free trials or promotional pricing. Free trials automatically convert to paid subscriptions unless canceled before the trial ends. We reserve the right to modify or withdraw promotions at any time.

7. Refund Policy

All refunds are handled directly by Apple in accordance with the App Store refund policy. We do not issue refunds directly for subscriptions or in-app purchases.

8. User Content and Data

You retain ownership of all recordings, transcripts, and other content you create using Kleonote (“User Content”). By using the app, you grant us a limited, non-exclusive, revocable license to process and store your User Content solely to provide app functionality, such as transcription and summaries.

We do not sell or share your recordings or transcripts for advertising or marketing purposes. You are responsible for ensuring your content complies with applicable privacy laws.

9. Data Storage and Processing

Kleonote processes and stores data using trusted third-party cloud providers that follow industry-standard security practices. While we take reasonable measures to protect your data, no system is completely secure, and you use the app at your own risk.

10. Intellectual Property

All rights, title, and interest in Kleonote, including software, design, text, graphics, and branding, are owned by or licensed to Vicky Hertman. You may not copy, modify, or reuse any part of the app without prior written permission.

11. AI-Generated Output

Kleonote uses AI technology to generate transcriptions, summaries, and insights. AI-generated content may contain errors or inaccuracies. You are responsible for reviewing and verifying any output before relying on it. We are not liable for decisions made based on AI-generated content.

12. Third-Party Services

Kleonote may integrate with third-party services such as analytics providers, transcription engines, or payment processors. We are not responsible for the content, policies, or practices of third-party services. Their use is governed by their own terms.

13. Disclaimer of Warranties

Kleonote is provided on an “as is” and “as available” basis without warranties of any kind. We do not guarantee uninterrupted operation, error-free performance, or complete accuracy.

14. Limitation of Liability

To the fullest extent permitted by law, Vicky Hertman shall not be liable for indirect, incidental, or consequential damages arising from your use of Kleonote. Our total liability shall not exceed the amount you paid for the app in the twelve months preceding the claim.

15. Termination

We may suspend or terminate access to Kleonote if you violate these Terms or misuse the app. You may stop using the app and cancel your subscription at any time. Provisions that should survive termination will remain in effect.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of Spain, without regard to conflict of law principles. Any disputes shall be resolved in the competent courts of Spain. You agree to attempt to resolve disputes with us before pursuing legal action.

17. Changes to the Terms

We may update these Terms at any time. Updated versions will be made available in the app or on our official page. Continued use of Kleonote constitutes acceptance of the revised Terms.
